Federal & State Legislative Update

Russell will cover updates to various legislative topics including FMLA updates, new ADA regulations, Labor Unions push to eliminate the secret ballot election as the method of deciding whether a union represents your employees or not. Additionally, he will advise us of the changes in statutory and regulatory laws governing the employment relationship and provide a better understanding of the changes being proposed to current statutory and regulatory laws in order to enable HR professionals to participate in the legislative process.

The FMLA has already been amended by statute, with additional regulatory proposals under consideration. Other proposals on expanding the FMLA litter the floors of Congress. Serious efforts are underway to significantly expand the definition of disability under the ADA, and will probably have passed Congress by the time of our meeting in November. Legal protection based on sexual orientation is poised for passage as well. Labor unions are gearing up for a major push to eliminate the secret ballot election as the method of deciding whether a union represents your employees or not. But the U.S. Congress is not the only battleground. Gridlock in Washington has moved legislative advocacy on employment matters to the states. Come hear some of the trends of legislation being proposed in the Statehouses across the country. 2008 WCASHRM Scholarship Awarded to Courtney Benson
